1. Acceptance of Terms

By registering for, accessing, or using Rented Souls Avatars (the "Platform", "Service", "we", "us", or "our"), you ("User", "you", or "your") acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations. If you do not agree with these Terms in their entirety, you are prohibited from using or accessing this Platform.

These Terms constitute a legally binding agreement between you and Rented Souls Avatars. Your continued use of the Platform constitutes acceptance of any modifications to these Terms.

2. Service Description

Rented Souls Avatars is an artificial intelligence-powered platform that provides automated content generation services, including but not limited to:

• AI-generated avatar and image creation
• AI-generated video content
• AI-powered voice synthesis and audio generation
• Digital persona creation and management
• Automated content editing and transformation

All content generated through the Platform is produced by artificial intelligence algorithms. The Platform operates on an automated basis with minimal human oversight of individual outputs.

3. User Responsibilities and Content Liability

3.1 Sole Responsibility for Content

YOU ARE SOLELY AND ENTIRELY RESPONSIBLE FOR ALL CONTENT YOU UPLOAD, CREATE, GENERATE, DISTRIBUTE, OR OTHERWISE USE THROUGH THE PLATFORM.

This includes but is not limited to:

• All images, photographs, videos, audio files, text, prompts, and any other materials you upload to the Platform
• All AI-generated content created using your uploads, prompts, or instructions
• Any modifications, edits, or derivatives of generated content
• Any distribution, publication, or use of generated content outside the Platform

3.2 Legal Compliance

You represent, warrant, and covenant that:

• You have all necessary rights, licenses, consents, and permissions for any content you upload
• Your use of the Platform and all generated content complies with all applicable local, state, national, and international laws and regulations
• You will not use the Platform to create, distribute, or facilitate any illegal content or activities
• You have obtained explicit consent from any individuals whose likeness, voice, or personal information appears in uploaded content
• You will not violate any third-party rights, including intellectual property rights, privacy rights, publicity rights, or contractual rights

3.3 Prohibited Uses

You expressly agree NOT to use the Platform to create, upload, generate, or distribute content that:

• Is illegal, fraudulent, defamatory, obscene, pornographic, or otherwise objectionable
• Violates any applicable law, statute, ordinance, or regulation
• Infringes upon intellectual property rights, privacy rights, or any other rights of any third party
• Contains malware, viruses, or any harmful code
• Depicts minors in any inappropriate, suggestive, or harmful manner
• Creates unauthorized deepfakes or misleading representations of real individuals
• Promotes violence, terrorism, hate speech, discrimination, or harassment
• Impersonates any person or entity without authorization
• Violates any person's right to privacy or publicity
• Contains false, misleading, or deceptive information
• Is used for spam, phishing, or other malicious purposes

3.4 Indemnification for User Content

YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS RENTED SOULS AVATARS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SUPPLIERS FROM AND AGAINST ALL CLAIMS, LOSSES, EXPENSES, DAMAGES, AND COSTS, INCLUDING REASONABLE ATTORNEYS' FEES, RESULTING FROM:

• Any content you upload, create, or generate using the Platform
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable laws or regulations
• Any claims that your content caused harm to a third party

4. Platform Disclaimers and Limitations

4.1 No Responsibility for Generated Content

RENTED SOULS AVATARS DOES NOT REVIEW, MONITOR, ENDORSE, OR TAKE RESPONSIBILITY FOR ANY CONTENT GENERATED THROUGH THE PLATFORM.

We explicitly disclaim all responsibility and liability for:

• The accuracy, quality, legality, or appropriateness of any AI-generated content
• Any offensive, inappropriate, obscene, unlawful, or otherwise objectionable content generated by users
• Any harm, damage, or loss resulting from generated content
• Any copyright, trademark, or other intellectual property infringement in generated content
• Any privacy violations or unauthorized use of personal information in generated content

4.2 AI Limitations and Unpredictability

You acknowledge and agree that:

• AI-generated content is inherently unpredictable and may produce unexpected, inaccurate, or inappropriate results
• The Platform cannot guarantee the quality, accuracy, or suitability of any generated content
• Generated content may contain errors, biases, or offensive material despite our best efforts
• The Platform uses third-party AI models over which we have limited control
• You use all generated content at your own risk and discretion

4.3 No Endorsement or Condemnation

The availability of content generation tools on this Platform does not constitute endorsement, approval, or condemnation of any content created by users. We are a technology service provider offering automated tools. Users are solely responsible for how they use these tools and the content they create.

5. Account Termination and Enforcement

We reserve the right, in our sole discretion, to:

• Terminate or suspend your account immediately without notice or liability for any reason, including violation of these Terms
• Remove, delete, or refuse to display any content that violates these Terms or applicable laws
• Report illegal activities to law enforcement authorities
• Cooperate with legal investigations and court orders
• Take legal action against users who violate these Terms

Account termination does not relieve you of liability for content you created or actions you took while using the Platform.

6. Payment Terms and No Refund Policy

6.1 Payment and Billing

By purchasing credits, subscriptions, or any paid services on the Platform, you agree to pay all applicable fees as described at the time of purchase. All fees are non-refundable except as required by law.

6.2 No Refund Policy

ALL PURCHASES ARE FINAL. WE DO NOT OFFER REFUNDS OR CREDITS FOR:

• Unused credits, subscriptions, or services
• Dissatisfaction with generated content quality or results
• Technical issues, service interruptions, or downtime
• Account termination or suspension for Terms violations
• Changes in pricing or service features
• Failure to use purchased credits before expiration
• Any other reason, whether stated or not

By making a purchase, you acknowledge and accept this no refund policy.

6.3 Credit Expiration

Purchased credits may expire according to the terms specified at the time of purchase. Expired credits cannot be refunded, restored, or exchanged.

6.4 Price Changes

We reserve the right to modify pricing at any time. Price changes will not affect credits or subscriptions already purchased but will apply to future purchases.

7. Intellectual Property Rights

7.1 User Content Ownership

You retain ownership of content you upload to the Platform. However, by uploading content, you grant us a worldwide, non-exclusive, royalty-free license to use, process, store, and display your content solely for the purpose of providing the Service.

7.2 Generated Content

Subject to your compliance with these Terms and applicable laws, you have the right to use AI-generated content created through your account. However, you acknowledge that:

• AI-generated content may not be eligible for copyright protection in some jurisdictions
• Similar or identical content may be generated for other users using similar prompts
• We make no warranties regarding the uniqueness or originality of generated content
• You are responsible for ensuring your use of generated content does not infringe third-party rights

7.3 Platform Ownership

The Platform, including all software, algorithms, designs, text, graphics, and other content (excluding user-uploaded and user-generated content), is owned by Rented Souls Avatars and is protected by copyright, trademark, and other intellectual property laws.

8. Disclaimer of Warranties

THE PLATFORM AND ALL SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• WARRANTIES REGARDING ACCURACY, RELIABILITY, OR QUALITY OF GENERATED CONTENT
• WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
• WARRANTIES THAT DEFECTS WILL BE CORRECTED
• WARRANTIES REGARDING THE RESULTS OBTAINED FROM USING THE SERVICE

YOU USE THE PLATFORM AT YOUR OWN RISK. WE DO NOT WARRANT THAT THE PLATFORM WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RENTED SOULS AVATARS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES
• DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
• DAMAGES RESULTING FROM YOUR USE OR INABILITY TO USE THE PLATFORM
• DAMAGES RESULTING FROM ANY CONTENT GENERATED THROUGH THE PLATFORM
• DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO YOUR ACCOUNT OR CONTENT
• DAMAGES RESULTING FROM THIRD-PARTY CONDUCT OR CONTENT
• DAMAGES RESULTING FROM SERVICE INTERRUPTIONS, ERRORS, OR TECHNICAL ISSUES

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS LESS.

THESE LIMITATIONS APPLY EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF THE LEGAL THEORY OF LIABILITY.

10. Third-Party Services and Content

The Platform may integrate with or rely on third-party AI models, services, and technologies. We are not responsible for:

• The availability, accuracy, or functionality of third-party services
• Changes to third-party services that affect Platform functionality
• Third-party terms of service or privacy policies
• Content generated by third-party AI models

Your use of third-party services through the Platform is at your own risk and subject to those third parties' terms.

11. Data and Privacy

Your use of the Platform is also governed by our Privacy Policy. By using the Platform, you consent to our collection, use, and disclosure of your information as described in the Privacy Policy.

You acknowledge that uploaded content and generated content may be processed by third-party AI services and stored on third-party servers.

12. Modifications to Terms

We reserve the right to modify these Terms at any time, in our sole discretion. We will notify you of material changes by:

• Posting the updated Terms on the Platform with a new "Last Updated" date
• Sending notice to the email address associated with your account (if applicable)

Your continued use of the Platform after changes are posted constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Platform.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Rented Souls Avatars operates, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration association, except where prohibited by law.

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published on the Platform, constitute the entire agreement between you and Rented Souls Avatars regarding your use of the Platform.
